Ector Louis Gonzalez, 34, died in a Los Angeles car accident the afternoon of July 28, 2009 after his car crashed into a tree on Crenshaw Boulevard in Torrance, California. According to a news report in the Daily Breeze, Gonzalez was headed south on Crenshaw Boulevard alone in the 2006 Nissan Sentra when he crashed into the median near Del Amo Boulevard, Torrance police officials said. Firefighters apparently had to extricate the man's body from the car.

Tustin Care Center in Orange County has been accused of nursing home negligence and fined for neglecting a nursing home resident, who California Health Department officials say, choked on his lunch and died. According to a news report in The Orange County Register, the man died in March after choking on his lunch. Apparently, staff members noticed that the man had been growing weaker and yet allowed him to eat regular meals on his own.

On the day he died, the man was eating soup with rice when he called out for his wife, who was also a patient. He then struggled to breathe and a nurse started the Heimlich maneuver, but could not dislodge the food. The man died later the same day, in a hospital. An autopsy reportedly found food completely blocking his trachea. Officials also concluded in their report that the nursing home failed to assess his ability to eat, which was a direct cause of his death.

I offer my deepest sympathies to the family of this man for their tragic loss. This type of death or serious personal injury could have been easily prevented with better monitoring on the part of the nursing home staff. My heart goes out to the family of this man. Please keep them in your prayers.

Understaffing is a Serious Problem

According to a Government Accountability Office (GAO) report in 2003, at least one in five of all nursing homes in the United States are plagued by serious deficiencies that place nursing homes residents in immediate danger or cause them actual harm. According to this report, quality of care in these nursing homes drops dramatically when residents receive less than three hours of the nurse’s and nurse’s aide’s time per day. Sadly that’s the case in about 54 percent of nursing homes. The report also states that nursing home staff are underpaid and overworked. Nursing aides, for instance, are paid $7 to $8 an hour for work that is often strenuous and stressful.

Nursing home negligence is directly related to understaffing at these facilities. The companies that own these nursing homes put profits over the vulnerable residents they are supposed to care for--and that should never, ever be acceptable. We don't know yet exactly what went wrong or who dropped the ball at this Orange County nursing home. But obviously, there was a great amount of negligence.

The family of this deceased victim would be well-advised to retain the services of an experienced Orange County personal injury lawyer who will hold this nursing home accountable for this patient's fatal injuries. Where negligence or wrongdoing is involved, families of deceased victims could file a wrongful death claim. Such claims seek compensation for medical/funeral expenses, loss of earnings, loss of companionship and other related damages. Frankly, such lawsuits are not just about money. I believe they will bring about changes at these nursing facilities and prevent future incidents of negligence and/or abuse.

Four people were injured in a San Bernardino, California car accident the afternoon of July 26, 2009 caused by a wrong-way driver on the 215 Freeway. According to the San Bernardino Sun, a brown sedan entered the freeway on an off-ramp and drove northbound on southbound lanes. California Highway Patrol officials said four to five cars were involved in the car accident. CHP officials are looking into whether the driver of the sedan was under the influence of alcohol or drugs. Two people suffered serious injuries and two other suffered moderate injuries. Janice Ayala Torres, a 22-year-old woman sustained major injuries in a County California car accident, but her two-month-old child is safe because of being strapped properly in an infant car seat. According to a news report in the Victorville Daily Press, the accident occurred July 23, 2009 when Torres apparently pulled out into an intersection past a stop sign and into the path of a Ford Excursion driven by a 40-year-old woman, identified as Candance Howell. A 9-year-old girl has died in a Los Angeles County swimming pool accident after she drowned in a backyard pool in Arcadia, California. According to a news report in the Pasadena Star-News, the swimming pool accident occurred the afternoon of July 20, 2009 when she and other children were playing in the backyard pool. Officials say the girl, who has not been identified, was a visitor at the home. She was found underwater in the deep end. One of the children tried to rescue her before a homeowner jumped in to pull her out, Arcadia police said. The homeowners had initiated CPR when police arrived. Police in Los Angeles are looking for a hit-and-run driver who they say struck and killed 28-year-old Judy Ramos early morning on July 19, 2009. According to a CBS News report, Ramos was fatally injured in the Los Angeles car accident, which occurred on Vaughn Street near Glenoaks Boulevard in Pacoima. Ramos was trying to cross the street when she was hit by a white, four-door vehicle, LAPD officials say. Apparently, the driver did not stop and took off after hitting Ramos. Police in Montclair are looking for the public's help to get more details about a major California car accident caused by a suspected drunk driver, which seriously injured two people. According to a news report in the Inland Valley Daily Bulletin, a 1991 Jeep Wrangler was traveling north on Ramona early morning on July 19, 2009 when it was struck in an intersection by a 2000 Chevy S-10 pickup truck driven by Rogelio Ocon Jr., 30. The truck was going west on Mission Boulevard. The Wrangler reportedly spun several times. Both the driver and the passenger of the Jeep were ejected and severely injured, Montclair police officials say.

Police also believe that Ocon was under the influence of alcohol at the time of the car crash. He was arrested on suspicion of driving under the influence of alcohol. Luv N' Care Ltd. is issuing a nationwide defective product recall of gel-filled teethers with the brand names "Nuby," "Cottontails" and "Playschool" because the liquid inside the gel-filled teethers has been found to contain a harmful bacteria that can have serious consequences if children ingest the liquid gel. According to a news report in Consumeraffairs.com, the bacteria (Bacillus subtilis and Bacillus circulans), generally do not cause illnesses in adults. But infants and children with weakened immune systems can experience serious symptoms such as stomach pain, vomiting, diarrhea and other illnesses if the teether becomes punctured and they ingest the gel. Consumers who have these teethers are asked to stop using them immediately and either discard them or return it to the place of purchase for a complete refund.

The company apparently issued the product recall after learning that the U.S. Food and Drug Administration found Bacillus subtilis in the teether and Bacillus circulans in the gel in samples from two lots they collected. So far, no illnesses have been reported. These gel-filled teethers were distributed through retail outlets nationwide. The products were also marketed on the Internet. The company has stopped production and distribution of these teethers and is notifying its distributors to return the products. Read the rest of this entry »
