A pedestrian was injured in an Orange car accident after being struck by one of two vehicles that crashed at a city intersection. According to a news report in The Orange County Register, the collision between a Kia Rio and Dodge Neon occurred the afternoon of May 13, 2010 at the intersection of Main Street and Palm Avenue when the Kia attempted to make a left turn. A woman walking her dog and another pedestrian were then struck by the Dodge, as they walked north on Main Street. Totally, four people were injured. One injured pedestrian was transported to a local hospital.
I sympathize with everyone who was injured in this accident. I hope no one suffered any serious injuries. I wish them all the very best for a speedy or complete recovery.
Pedestrian Accident Statistics
According to California Highway Patrol's 2008 Statewide Integrated Traffic Records System (SWITRS), there was one death and 49 injuries involving pedestrian accidents in Orange, California. In Orange County as a whole, 31 people died and 785 were injured as a result of pedestrian accidents during the same year.
Right-of-Way Issues
Based on this news report, it is not clear what caused the initial collision between the Dodge and the Kia at that intersection. It appears that the crash occurred when the Kia was making a left turn ahead of the oncoming Dodge. So, there is the question of whether the driver of the Kia failed to yield right-of-way to the other driver at the time.
According to California Vehicle Code section 21801 (a): "The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement, and shall continue to yield the right-of-way to the approaching vehicles until the left turn or U-turn can be made with reasonable safety."
Fault and Liability
In this particular case, if the driver of the Kia was at fault, then he or she could be held liable for the accident and injuries caused to the other driver as well as the pedestrians. In cases where negligence or wrongdoing is involved, injured victims can seek compensation to cover medical expenses, lost earnings, cost of hospitalization, physical therapy and other related damages.
It would be in the best interest of victims and their families involved in these types of accidents to contact an experienced Orange County personal injury lawyer, who will analyze all facets of the injury crash and make sure that the negligent parties are held accountable for their actions. A knowledgeable car accident lawyer will also advise victims about how their car insurance policy might apply to an incident where the at-fault motorist is uninsured or underinsured.
