Long Beach Car Accident Kills Bicyclist
November 9th, 2009 | JohnA man was killed in a Long Beach car accident the night of November 6, 2009, as he rode his bicycle across the intersection of Magnolia Avenue and 6th Street in Long Beach, the Press Telegram reports. Police say a preliminary investigation showed that the victim, who has been identified only as a 65-year-old Asian man, was crossing 6th Street against a red light when he was struck by an eastbound 1995 Chevrolet van. The victim was taken to an area hospital where he succumbed to his critical injuries. The driver of the Chevy van was interviewed and released at the scene. An investigation is still ongoing. Anyone who witnessed this fatal car accident or has more information about it is asked to call Long Beach Police Department at 562-570-7355.
I offer my heartfelt sympathies to the family and friends of this deceased victim. My heart goes out to everyone who knew and loved this man. Please keep them in your prayers.
Long Beach Bicycle Accidents
There was one fatality and 186 injuries involving bicycle accidents in Long Beach in 2007, according to California Highway Patrol's Statewide Integrated Traffic Records System (SWITRS). Countywide, in 2007, 27 deaths and 2,902 injuries were reported as a result of bicycle accidents. Also, during the same period, 39 people lost their lives and 2,212 people were injured in Long Beach car accidents.
A preliminary investigation in this case has apparently led investigators to believe that the bicyclist was riding his bike against a red light. If I were a member of the deceased victim's family, I would push for a more thorough investigation. As a car accident lawyer, I have seen in many cases that the preliminary investigation, especially concerning right-of-way issues, can be erroneous. I would also want to know whether the driver of van was going too fast, distracted or otherwise negligent.
Contacting a Personal Injury Lawyer
In such cases, victims or their families, would be well-advised to consult an experienced Long Beach personal injury lawyer, who will stay on top of the official investigation and make sure that the victim's and family's rights and best interests are protected. A skilled car accident lawyer should also look into whether there was a dangerous condition on the roadway, which may have caused or contributed to this accident. If that was the case, the city or governmental agency responsible for maintaining that roadway could be held liable. Any claim against a governmental agency must be filed within 180 days of the accident or injury, according to California Government Code.
