A pedestrian sustained injuries in a Los Angeles car accident the morning of July 14, 2010 after being hit by a vehicle at a Glendale intersection. According to a CBS News report, the injury collision that occurred at the intersection of Central Avenue and Mountain Street, is still under investigation. Glendale police say the pedestrian was treated at the scene and that the extent of his or her injuries is not known.
My heart goes out to this injured pedestrian. I wish the victim the very best for a speedy and complete recovery. Please keep this individual in your thoughts and prayers.
According to California Highway Patrol's 2008 Statewide Integrated Traffic Records System (SWITRS), there were three fatalities and 91 injuries involving pedestrian accidents in Glendale. In Los Angeles County as a whole, 214 deaths and 4,985 injuries were reported as a result of pedestrian accidents during the same year.
Based on this news report, it appears that the accident occurred at a street intersection. It is not clear whether the pedestrian was walking in a crosswalk. If that was the case, the motorist is required under the law to yield right-of-way. California Vehicle Code section 21950 states: "The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection." The same section also states that the driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk "shall exercise all due care and shall reduce the speed of a vehicle or take any other action relating to the operating of the vehicle as necessary to safeguard the safety of the pedestrian."
Injured victims would be well-advised to seek the counsel of an Los Angeles personal injury lawyer, who will examine all facets of the incident and make sure that the negligent parties are held responsible. If the driver is determined to have been at fault, then, the victim can claim compensation for injuries sustained as a result of the crash. Injured victims can seek compensation to cover medical expenses, loss of earnings, cost of hospitalization and other damages.
A skilled car accident lawyer can also determine whether a dangerous roadway or intersection may have caused or contributed to the accident. If that was the case, the city or governmental agency responsible for maintaining the roadway could also be held liable. Please remember that any claim against a California governmental entity must be properly filed within 180 days of the accident or injury.
