Javier Escobar Jr., 26, was killed in a Riverside car accident the night of December 14, 2009, after he lost control of his vehicle and crashed on the Interstate 10. According to a news report in The Desert Sun, Escobar was driving on the 10 Freeway eastbound when he lost control of his Jeep near Date Palm Drive. The Jeep hit the center divider and rolled at least two times. Escobar was ejected from the vehicle and died later at a local hospital. California Highway Patrol officials suspect that both speed and alcohol were factors in this fatal car accident.

I offer my deepest sympathies to the family and friends of Javier Escobar for their devastating loss. Please keep them in your prayers.

Car Accident Statistics

According to California Highway Patrol's 2007 Statewide Integrated Traffic Records System (SWITRS), 279 deaths and 9,925 injuries were reported as a result of car accidents in Riverside County. The National Highway Traffic Safety Administration (NHTSA) reports that every year in the United States, about 10,000 people are killed in rollover accidents. That accounts for 25 percent of all traffic accident fatalities in the country.

What Caused the Accident?

In this particular case, officials are saying that Escobar may have been driving at a high rate of speed and that alcohol may have been a factor. However, the article does not state whether Escobar was wearing his seatbelt at the time of the crash. If he was buckled up, why was he ejected from the vehicle? Were there any seatbelt defects in the Jeep, which caused Escobar to become ejected and sustain fatal injuries? If I were a family member of this car accident victim, I would certainly want to know what happened here.

It is possible that there was a seat restraint system failure here. It is unfortunately quite a common occurrence in violent crashes, especially rollover accidents. A seatbelt system can fail due to false latching or failures that involve various parts such as webbing, grabbers, mounts and buckles.

Auto Product Liability Issues

Such cases require a California personal injury lawyer with extensive experience in auto product liability lawsuits, who will have the crashed vehicle thoroughly examined for any evidence of product defects and malfunctions. To assist with this, the victim's family should preserve the vehicle in its current condition, unaltered. A skilled auto product defect lawyer will also have the body of the ejected person carefully examined for evidence of seatbelt bruising and marking, and have the webbing tested microscopically for marks, blood stains or other indicators that would prove that the seat belt was in use at the time of the crash.
