A 7-year-old child sustained injuries in a San Diego car accident the morning of October 22, 2009 on the way to school. According to a 10news report, the child was hit on Byrd Street near Finney Elementary School in the Otay Mesa area of San Diego. Paramedics took the injured child to an area hospital. The identity, gender or nature of injuries to the child, are not known at this time.
My heart goes out to this young child. The number of accidents in school zones seems to have dramatically increased in Southern California and it is appalling that cities and school districts are not doing much about it. I wish this injured victim the very best for a quick and complete recovery and I hope the child's injuries were not very serious. This child will be in my prayers.
San Diego Pedestrian Accident Statistics
According to California Highway Patrol's 2007 Statewide Integrated Traffic Records System (SWITRS), 25 deaths and 575 injuries were reported as a result of pedestrian accidents in the city of San Diego. In San Diego County as a whole, pedestrian accidents claimed 51 lives and caused 1,068 injuries in 2007. Also, during the same period, 268 deaths and 14,641 injuries were reported in San Diego County as a result of car accidents.
This news report does not offer much information about who or what caused this accident. There are more questions than answers at this point. Was the child walking in a crosswalk? Was the child walking along the side of the road? Was the driver impaired, speeding, distracted or negligent in some other way? Or did the child walk or run into the path of the car? The fault in these cases could lie with the pedestrian or the motorist depending on the circumstances.
Pedestrian Accident Liability Issues
If the victim's family in this case suspects negligence or wrongdoing on the part of the driver, they will be well-served to contact an experienced San Diego personal injury attorney who will analyze all aspects of this case and help determine whether the motorist's negligence caused the accident and the resulting injuries. If that was the case, the driver could be held financially responsible for the medical expenses and other incidental costs incurred by the child's family. A skilled car accident attorney will also look into whether a dangerous condition on the roadway may have caused or contributed to this accident. If that was the case, the city or governmental agency responsible for maintaining that roadway could also be held liable. Please remember that any claim in California involving a governmental entity must be filed within 180 days of the accident or injury.
