Eric Sean Enockson, 36, was killed in a San Diego car accident after his motorcycle was rear-ended and dragged down Interstate 8 by a hit-and-run driver who was later arrested for driving under the influence. The fatal motorcycle accident occurred the morning of October 17, 2009 when 27-year-old Claudia Herrera, who was driving a Chevrolet Astro van at about 100 mph, crashed into the back of the motorcycle. Enockson was dragged under the van for quite a distance as Herrera continued on the freeway, California Highway Patrol officials said. Herrera was later arrested not far from the scene of the accident on suspicion of felony driving under the influence, hit-and-run and vehicular manslaughter.

My heart goes out to the family and friends of Eric Sean Enockson for their heartbreaking loss. I offer my deepest condolences to everyone who knew and loved this man. Please keep them in your prayers.

Motorcycle Accidents in San Diego

According to California Highway Patrol's 2007 Statewide Integrated Traffic Records System (SWITRS), 12 fatalities and 293 injuries were reported in the city of San Diego as a result of motorcycle accidents. In San Diego County as a whole, 50 fatalities and 985 injuries occurred in 2007 as a result of motorcycle accidents.

If the details of this news report are accurate, Claudia Herrera should be prosecuted to the fullest extent of the law. Not only did she allegedly drive under the influence, but also apparently left the scene of the accident, after dragging the injured victim under her vehicle at 100 mph on a freeway. Appalling!

California Car Accident Laws

Both driving under the influence and leaving the scene of an accident are illegal under California law. California Vehicle Code Section 23152 (a) states: "It is unlawful for any person who is under the influence of any alcoholic beverage or drug, or under the combined influence of any alcoholic beverage and drug, to drive a vehicle." The same code section also states that it is illegal for any person with a blood alcohol content of 0.08 percent or more to drive a vehicle. Also, California Vehicle Code section 20001 states: "The driver of a vehicle involved in an accident resulting in injury to a person, other than himself or herself, or in the death of a person shall immediately stop the vehicle at the scene of the accident."

Enockson's family would be well-advised to retain the services of an experienced personal injury attorney in San Diego who will stay on top of the criminal investigation, make sure the family's rights are protected and that they receive just compensation for the damages and loss they have suffered. Where negligence or wrongdoing is involved, families of deceased car accident victims may be able to file a wrongful death claim to seek compensation to cover funeral or medical expenses, loss of earnings, loss of companionship and other related damages.
