A 54-year-old woman was killed in a San Diego car accident, which police report, was caused by a hit-and-run driver. According to a 10News report, the fatal hit-and-run pedestrian accident occurred on Third Avenue in Chula Vista the night of December 25, 2010. The woman was crossing the street when she was struck and killed by a white Pontiac sedan. Witnesses reported a partial license plate to police. The abandoned sedan was found a short distance away from the scene of the accident. Police, however, tracked down the owner of the vehicle, identified as 23-year-old Angel Gutierrez, and arrested him on suspicion of felony hit-and-run and vehicular manslaughter. It is not clear if alcohol or drugs were involved.
My heartfelt condolences go out to the family and friends of the woman killed in this hit-and-run car accident. Police say she was a transient in the area. My thoughts and prayers are with the victim's grieving family members.

Hit-And-Run Car Accidents
Leaving the scene of an injury car accident is an unconscionable act, and is also illegal. Drivers are required under California law to stop and remain at the scene of a car accident, regardless of whose fault the car accident was. California Vehicle Code Section 20001 (a) states: "The driver of a vehicle involved in an accident resulting in injury to a person, other than himself or herself, or in the death of a person shall immediately stop the vehicle at the scene of the accident." In this case, the driver not only struck and fatally injured the pedestrian, but also left her lying on the roadway without making any attempt to seek medical aid for the victim. Appalling! I'm relieved that the suspect has been apprehended and will face prosecution.
The family of a hit-and-run car accident victim would be well-advised to seek the counsel of an experienced San Diego personal injury lawyer, who will stay on top of the official investigation and ensure that their legal rights and best interests are protected. A knowledgeable car accident attorney will also be able to advise families about how their own car insurance policy might apply to an incident where the at-fault driver is uninsured or underinsured.
