A 17-year-old boy was injured in an Orange County car accident after he was hit by a pickup truck while crossing the street. According to a news report in The Orange County Register, the pedestrian collision occurred the night of April 13, 2010 on Knott Avenue, close to the 91 Freeway in Buena Park. The teenager was running alongside another teen, across the street and toward a van that was parked on Knott. The other teen apparently made it across the road, but a 1996 Ford Ranger struck the 17-year-old. He sustained injuries including cuts and abrasions. His injuries are not believed to be life-threatening. He was taken to an area emergency room, treated and released. No citations have been issued pending an investigation.

I'm relieved to hear that the young man was not badly injured in this crash. It could have been a lot worse. I wish him the very best for a speedy and complete recovery from his injuries.

Pedestrian Accident Statistics

There were three deaths and 22 injuries involving pedestrian accidents in Buena Park in 2008, according to California Highway Patrol's Statewide Integrated Traffic Records System (SWITRS). In Orange County as a whole, pedestrian accidents claimed 31 lives and caused 785 injuries during the same year.

Pedestrian Laws in California

If the details of this news report are accurate, it appears that the teenager was running across the street to get to the van that was picking him up. It is not clear whether he was in a crosswalk or intersection at the time. California law requires motorists to yield right-of-way to pedestrians walking in marked or unmarked crosswalks, and intersections. However, pedestrians have a duty to use caution and walk only in areas designated for pedestrians.

Liability Issues

In this case, if the teens had darted across the roadway, unmindful of approaching vehicles, then, it is likely their fault. However, if the driver of the vehicle is determined to have been at fault or negligent, he or she could be held liable for the injuries caused. In some pedestrian accident cases, a dangerous roadway or intersection could also cause or contribute to a collision. Any personal injury claim against a governmental entity in California must be properly filed within 180 days of the accident or injury. An experienced Orange County personal injury lawyer will be able to better advise pedestrian accident victims about their legal rights and options.
