A bicyclist has been injured in a Newport Beach car accident, after he was hit by a car at the intersection of Jamboree Road and Bison Avenue the morning of December 9, 2009, The Orange County Register reports. The driver of the car did not stop and left the scene of the accident. The bicycle rider, who was estimated to be in his mid-40s, was taken to an area trauma unit. Elizabeth Amstone, 18, was killed in a Los Angeles car accident after the driver of the car in which she was a passenger lost control and crashed the vehicle in Irwindale. According to a news report in the San Gabriel Valley Tribune, the car accident occurred the morning of December 1, 2009 after a 1995 Acura Integra, driven by Deshawn Johnson, 17, heading southbound on the 605 Freeway near Arrow Highway, veered to the right and on to a dirt embankment before rolling over on the shoulder. Amstone was ejected and fell partially on to the far right lane, California Highway Patrol officials said. It is not clear how fast the car was going or why it went off the road. CHP officials are not sure whether Amstone was wearing her seatbelt. She died at the scene while Deshawn escaped with minor injuries to his left hand and right leg.

As products liability attorneys, we know that the makers of defective products often drag their feet on product recalls even when they have known for several years that those products could cause serious personal injury or even death to their unsuspecting consumer. Here's a perfect example of what I'm talking about. Maclaren, a manufacturer of strollers, agreed to a voluntary recall earlier this month, of all models of its products sold as far back as 1999 admitting that the fingers of 12 children were cut off by the stroller's hinges when they were opened or closed. What we're just hearing about now is that Maclaren knew about its product defects at least for the last five years, but did absolutely nothing about it. According to an article in the New York Post, Maclaren is now facing a fine of $1 million or more because they failed to report this potential hazard to the U.S. Consumer Product Safety Commission.

Los Angeles-based Sterling Pacific Meat Co., has recalled more than 3,500 pounds of ground beef products over food poisoning concerns. According to an Associated Press news report, the ground beef patties may be contaminated with E. coli bacteria. The Department of Agriculture's Food Safety and Inspection Service announced the recall. So far, no illnesses have been reported. The recalled beef products were reportedly produced on May 18 and distributed to wholesalers who sold them to restaurants in California and Arizona. The ground beef patties were sold under the Fatburger and Stock Yards brands.

Luv N' Care Ltd. is issuing a nationwide defective product recall of gel-filled teethers with the brand names "Nuby," "Cottontails" and "Playschool" because the liquid inside the gel-filled teethers has been found to contain a harmful bacteria that can have serious consequences if children ingest the liquid gel. According to a news report in Consumeraffairs.com, the bacteria (Bacillus subtilis and Bacillus circulans), generally do not cause illnesses in adults. But infants and children with weakened immune systems can experience serious symptoms such as stomach pain, vomiting, diarrhea and other illnesses if the teether becomes punctured and they ingest the gel. Consumers who have these teethers are asked to stop using them immediately and either discard them or return it to the place of purchase for a complete refund.

The company apparently issued the product recall after learning that the U.S. Food and Drug Administration found Bacillus subtilis in the teether and Bacillus circulans in the gel in samples from two lots they collected. So far, no illnesses have been reported. These gel-filled teethers were distributed through retail outlets nationwide. The products were also marketed on the Internet. The company has stopped production and distribution of these teethers and is notifying its distributors to return the products. Read the rest of this entry »

Over the last few years, the defective auto products liability attorneys at Bisnar | Chase have highlighted the many product defect issues relating to defective tires. The most recent recall involving defective tires has been issued by Kumho Tire USA, which is recalling about 36,000 Mohave light truck all-terrain tires. This product recall has been issued for sizes LT225/75R16, LT245/75R16, and LT265/75R16. These defective tires were manufactured between December 7, 2008 and June 2009. Apparently, the tires can cause the vehicle's handling to become difficult when operated under load or when changing lanes. This could cause the truck to sway and possibly crash. Kumho will notify owners of these defective tires and replace the tires free of charge when the recall begins later this month.

Tire defects are extremely serious because they have the potential to cause serious personal injury and death. A tire defect during the manufacturing process can result in a host of problems including tire tread separation. Defective tires can result in the vehicle becoming instable. Often, tire defects are responsible for rollover car crashes which end in major injuries or fatalities. Crane Plumbing has issued a defective product recall of 5,500 whirlpool bath tubs because the drain covers in the tubs can entangle a bather's hair in the opening causing their head to be held underwater, posing a drowning hazard. According to a news report in Consumeraffairs.com, these recalled bathtubs are acrylic with six to 12 jets. The Crane logo is printed on the whirlpool and on the air control valve. The tubs were sold at home improvement, retail and wholesale stores nationwide from March 2007 through February 2009 for between $700 and $2,700. Read the rest of this entry »
