Two elderly women were involved in a vehicle versus pedestrian accident, which occurred inside a privately owned mobile home park. The female pedestrian who was injured in this collision was identified as 79-year-old Walda Bradley. Bay City News reports that Bradley was walking in the 700 block of Mill Stream Drive in San Jose the afternoon of July 28, 2010, when a vehicle driven by a 75-year-old woman struck her. Bradley was taken to an area medical center where she was pronounced dead. An investigation is ongoing.
My heart goes out to everybody who knew and loved Walda Bradley. She will be in my thoughts and prayers.
Car Accidents
There were 44 fatalities and 3,627 injuries involving car accidents in San Jose. In Santa Clara County as a whole, 94 people died and 6,770 were injured as a result of car accidents during the same year.
Car Accidents Involving Elderly Drivers
This incident reminds us, yet again, about the important issue of our aging driving population. California now has almost 3 million drivers who are 65 years or older, according to the Department of Motor Vehicles. A recent study by Carnegie Mellon University in Pittsburgh and the AAA Foundation for Traffic Safety finds fatality rates for drivers begin to climb after age 65. In 2005, about 11 percent of fatal car accidents in the United States had involved drivers 65 or older.
Protecting Victims' Rights
In this particular case, it is not clear whether the accident occurred due to a health condition involving the elderly driver or if it was the pedestrian's fault. Where there is negligence or wrongdoing involved, families of deceased victims can file a wrongful death claim seeking compensation to cover medical or funeral expenses, lost future earnings, loss of love and companionship and other related damages. The best California personal injury lawyers will always offer a free and comprehensive consultation to injured victims and their families.
