Causes and Liability Issues
Based on this news report it is not quite clear who or what caused this accident. There are still several unanswered questions here. Did one of the drivers fail to yield right-of-way at the intersection? Did one of the drivers run a red light at the intersection? Was alcohol or drugs involved? Was any one of the drivers distracted, speeding or otherwise negligent? Was there any debris or a dangerous condition on the roadway, which may have caused or contributed to this accident?
Failure to yield right-of-way to an oncoming vehicle is a serious traffic violation, as is running a red light. The at-fault driver in this case could be held liable for the student's injuries and loss. In such cases, victims and their families would be well-advised to contact an experienced San Diego personal injury lawyer, who will analyze all aspects of the accident and make sure that the negligent parties are held responsible for their actions. If the school bus driver was at-fault, the bus company and the school district could be held liable. Please remember that any claim against a governmental entity in California must be properly filed within 180 days of the accident or injury.
